'It reminds local authorities that, in planning to meet their objectively assessed local housing needs and other development needs, they should take account of constraints such as Areas of Outstanding Natural Beauty, which indicate development should be restricted.'

'PPS7 clearly advises that major developments should not take place within Areas of Outstanding Natural Beauty, except in exceptional circumstances.  This application proposes a total floorspace of 1903 square metres of work and multi space (B1 use).  The scale of the development is clearly in conflict with this advice.'

Best Practice

Caithness and Sutherland created a great interactive document for their local development plan consultation.  The online version of the document links to survey forms to capture comments and has links throughout to allow easy navigation between sections.  To take a look, click here.

'Failure to engage communities properly at an early stage is one of the main causes of conflict later in the
planning process. This can lead to additional costs and delays.'  'Common mistakes include things like consulting too late, placing a thick document on a stand in the library or on a web site and expecting people to read it, or talking at people at a public meeting.'

'The consultation process will need to be carefully designed with clear questions asked, and with people given easy-to-understand instructions to identify which parts of the draft Neighbourhood Plan or the accompanying documents they are commenting upon.'

'Neighbourhood Planning groups need to adopt a high standard of engagement and take many different parties along with them. Without this, there is a risk they will lose at referendum. Councillors can play a role in encouraging engagement locally.'

National Policies

'Local Plans should meet objectively assessed needs, with sufficient flexibility to adapt to rapid change, unless: specific policies in this Framework indicate development should be restricted.  For example, those policies relating to land designated as Green Belt, Local Green Space, or an Area of Outstanding Natural Beauty.' (Extracts from section 14).

Local Policies

'All development proposals in or adjacent to the Cotswolds AONB will be required to conserve and, where appropriate, enhance its landscape, scenic beauty, wildlife, cultural heritage and other special qualities. Proposals will be required to be consistent with the policies set out in the Cotswolds AONB Management Plan.'

'Within the Cotswolds AONB there are various rural ‘brownfield sites’ (i.e. previously developed land and buildings).  The impact on the character of the AONB by the reuse of these sites can be significant if for residential or industrial use. Change of use of existing buildings can have an impact on adjoining properties and the wider countryside, as well as bringing a potential increase in traffic movements.'

'There would appear to be little or no locally derived requirement either for four or five bedroom homes or for large scale development on the periphery of the Town. There is a clear perception that if future growth is not adequately controlled then the Town’s physical and social infrastructure may be stretched beyond its natural capacity.'

Neighbourhood Plan Examples

'The planning strategy for Cuckfield generally is to focus development within the defined Built up Area Boundary and to restrict development in the countryside in order to protect landscape of major or substantial value or sensitivity, views from public areas, formal and informal recreational amenities as well as biodiversity.'
